Dual-Use Trade Controls
The export, transit and brokering of dual-use items is subject to licensing by the Commerce Department.
Dual-use items are goods, software or technology which can be used for both civilian and military applications. These are listed in Annex 1 to Council Regulation (EU) 2025/2003 of the European Parliament and of the Council of 15 September 2023 setting up a Union regime for the control of exports, brokering, technical assistance, transit and transfer of dual-use items (recast). This is directly applicable in all EU countries including Malta, to which Subsidiary Legislation 365.12 also applies.
