The reason for this communication is to kindly inform you that the Common Communication on the Implementation of ‘IP Translator’ v.1.2 of 20 February 2014 will be affected by the implementation of the European Union Trade Mark Regulation No. 2015/2424 with respect to the use of general indications included in the Class headings (articles 28(5) and 28(8) EUTMR). In accordance with Article 28(5) and 28(8) EUTMR all trade marks containing class headings will be interpreted according to their literal meaning regardless of their filing date, by the end of the transitional period. Therefore, the different interpretations of the Class Headings included in the IPT Common Communication will not be applicable and should be modified accordingly.
Apart from the modifications pertaining to EUIPO, we have also introduced a change for the Italian Office (UIBM) related to the dates of interpretation of the Class headings.
