A door-to-door
seller in terms of the Trading Licences Regulations S.L.441.07 offers goods or services through
a doorstep contract. This could be the result of a solicited response to an
advertisement or unsolicited by the person to whom the offer is made.
To
conduct such an activity a licence by the Trade Licensing Unit within the
Commerce Department is required. However, there are some exceptions:

It is only applicable to the sale of goods connected to commercial
activities listed in the Part 1 of the First Schedule to the Trading Licences
Regulation S.L. 441.07.

Vendors of food stuffs and drinks who sell their goods from door-to-door
do not fall in this category.
The application for a licence to conduct
a retail sale by door-to-door salespersons is an electronic form that is
preferably submitted online. Depending on the status of the entity applying for
a licence, the below listed supporting documents may be required on application:
- Non-Maltese residents
must supply a copy of their Passport.
- Moreover, non-EU
residents have to also supply a copy of the Employment Licence issued by
JOBSPLUS, a valid Residence Permit issued by Identity Malta and the VAT
Registration Certificate issued by the VAT Department.
- In the case of a company,
a Board Resolution signed by the Company Secretary authorising the
applicant to represent the company.
Should an application be refused and the applicant feels aggrieved by the decision of the Trade Licensing Unit or the Local Council, he may file an appeal in writing to the Licensing Appeals Board within ten (10) working days from the date of notification, in accordance with the provisions of Part VI of the Trading Licences Regulations SL441.07 The appeal can be sent to tradelicenceapplications@gov.mt or to Commerce Department, Trade services and Projects Directorate, Lascaris Bastions, Daħlet Ġnien is-Sultan, Valletta, VLT1933, Malta. Any person making an appeal to the Board shall, upon filing of such appeal, pay a fee of fifty-eight euro (€58).
The licence fee is of €50
per annum.
